Welcome to Ontigen. These Terms of Service ("Terms") govern your access to and use of the Ontigen platform, website, and services (collectively, the "Service"). By signing up for an account or using the Service, you agree to be bound by these Terms.

1. The Service & AI Disclaimer

Ontigen provides Generative Engine Optimization (GEO) and Answer Engine Optimization (AEO) analytics.

• Advisory Nature: All insights, scores, and recommendations provided by the Service are for advisory purposes only.
• Algorithm Volatility: Third-party AI engines (e.g., OpenAI, Google Gemini, Perplexity) frequently change their algorithms ("Model Drift"). Ontigen does not guarantee specific rankings or inclusion in AI-generated responses.
• No Control: Ontigen has no control over how third-party AI engines interpret your brand data.

2. Subscriptions, Credits & Billing

• Subscription Tiers: Services are billed in advance on a recurring periodic basis (monthly or annually).
• Credit Expiration: Monthly subscription credits follow a "Use it or Lose it" policy. Unused credits do not roll over to the next billing cycle.
• Upgrades: Subscription upgrades take effect immediately. Upon upgrading, any remaining credits from your current cycle will roll over into the new tier for the remainder of that specific cycle.
• Downgrades: Subscription downgrades take effect only at the end of your current billing cycle. No partial refunds are provided for downgrades.
• Auto-Renewal: Your Subscription will automatically renew unless cancelled at least 48 hours before the renewal date.
• Payment Failure: In the event of a payment failure, Ontigen will not replenish credits or provide access to premium features until the balance is settled. We reserve the right to restrict access to credit-based services without notice upon payment failure.

3. No Refund Policy

• Final Sale: All payments are non-refundable. This includes subscription fees, one-time credit purchases, and upgrades.
• Immediate Value: Because the Service provides immediate access to proprietary computational resources and data, we do not offer refunds for partial periods or unused credits.

4. Intellectual Property

• Ontigen Ownership: Ontigen retains all rights, title, and interest in the Service, including software, algorithms, and the specific formatting and methodology used in GEO reports.
• User Data: You retain ownership of the raw data and queries you input. You grant Ontigen a license to process this data to provide the Service.
• Marketing: Unless you notify us otherwise in writing, you grant Ontigen a non-exclusive license to use your company name and logo on our website and marketing materials to identify you as a customer.

5. Acceptable Use

You agree not to:

• Reverse engineer, crawl, or scrape the Ontigen platform.
• Use the Service to generate deceptive or harmful content.
• Circumvent rate limits or security measures.

6. Limitation of Liability

To the maximum extent permitted by law, Ontigen's total liability for any claim arising from the Service shall be limited to the amount you paid to Ontigen in the twelve (12) months preceding the claim. We are not liable for any indirect damages or loss of profits.

7. Governing Law & Jurisdiction
